Terms of Use

By creating an account, subscribing or using RobotiZap, you agree to these Terms of Use. If you do not agree, do not use the platform.
1. Who we are
RobotiZap is an automated booking platform via WhatsApp, operated by PK Systems (CNPJ 43.456.936/0001-34), with its registered office in Lajeado-RS, Brazil. RobotiZap is a Meta-certified Tech Provider and uses the Official WhatsApp Business API.
2. The service
RobotiZap provides a WhatsApp booking system for appointment-based businesses (barbershops, salons, clinics, practices, studios and self-employed professionals). It includes an online calendar, a Virtual Assistant and conversational AI, reminders, confirmations, deposit collection, commissions, reports and the other features described on the website. Use of the AI consumes credits, and additional credits may be purchased as set out in section 5.
The platform is accessed through a web dashboard. We do not supply hardware or any mandatory native app. For some features, we offer an installable app (PWA).
3. Registration and account
• You must be at least 18 years old and have the legal capacity to enter into the service agreement.
• The information provided at registration must be true, complete and up to date.
• You are solely responsible for keeping your password confidential and for all activity carried out on your account. Notify us immediately of any unauthorised use.
• We may suspend or close accounts that contain false information, breach these Terms or show signs of fraud.
4. Free trial period
We offer a 7-day free trial, with no credit card required. Nothing is charged automatically at the end of the trial. To continue, you activate the subscription from the dashboard and the first invoice is issued as set out in section 5.
5. Price, billing and payment
• The subscription is billed on a recurring monthly cycle, at the single price published on the website.
• In Brazil, payment is by Pix or credit card. In all other countries, payment is by Visa or Mastercard. The amount and currency are shown in the dashboard, according to the business's country.
• Additional AI credit packs are optional purchases, at a fixed price shown before confirmation. They are only charged when you choose and confirm the purchase in the dashboard. There is no automatic usage-based charging and no change in price without your confirmation.
• A tax invoice (nota fiscal) is issued by PK Systems for each paid invoice, whether for the subscription or a credit pack.
• In the event of non-payment, we may suspend access to the platform after the due date, without further notice beyond the payment collection attempts.
We may adjust prices with 30 days' prior notice. Any adjustment does not apply to invoices already issued.
Saved card for payments
• When paying by credit card, you may authorise the card to be saved for future charges. Card details are stored securely (tokenised) by our payment intermediary. RobotiZap does not store the full card number or the security code.
• With a saved card, you authorise us to charge it for: (a) the monthly subscription fee, automatically at each cycle, at the price in force under this section; and (b) the credit packs you confirm in the dashboard, at the price shown before confirmation.
• You may change the saved card at any time from the dashboard or ask for it to be removed through support. Cancelling the subscription stops future monthly charges, as set out in section 6.
6. Cancellation
• You may cancel the subscription at any time from the admin dashboard, with no cancellation fee or minimum term.
• On cancellation, any outstanding invoices are cancelled and no new invoice is issued.
• After cancellation, access continues until the end of the cycle already paid for. There is no pro rata refund for unused days.

7. Acceptable use
By using RobotiZap, you undertake to:
• Comply with applicable Brazilian law, in particular the LGPD, the Marco Civil da Internet (Brazilian Internet Civil Framework) and the Código de Defesa do Consumidor (Consumer Protection Code).
• Comply with Meta's policies for WhatsApp Business, including the Commerce Policy, the Messaging Policy and the opt-in rules for sending messages to end customers.
• Not use the platform to send spam, unauthorised bulk messages, or content that is illegal, fraudulent, offensive or infringes the rights of third parties.
• Obtain appropriate consent from your end customers for the processing of their data, where applicable.
• Not carry out reverse engineering, mass scraping, intentional overloading or attempts at unauthorised access to the platform's infrastructure.
Non-compliance may result in the suspension or closure of the account, without prejudice to any other applicable legal measures.
8. Connection to WhatsApp
• Official WhatsApp Business API: as a Meta-certified Tech Provider, we offer the official connection. Connected numbers are subject to Meta's policies and fees. These fees (for example, for marketing messages) are charged by Meta itself, to the payment method registered in your Meta account, with no mark-up from RobotiZap.
• Alternative connection via QR code/pairing: we make this option available as a convenience. As it is not an official Meta channel, it is subject to instability and to the risk of the number being blocked by WhatsApp. Choosing this option is your decision, and RobotiZap cannot prevent, or be held responsible for, restrictions applied by Meta in such cases.
Changes to WhatsApp's policies or API by Meta may affect platform features. We make every effort to adapt the service, but we cannot guarantee uninterrupted availability in the face of changes made by third parties.
9. Ownership of data and content
• The data you enter into the platform (business details, services, calendar, customers, messages) remains your property.
• You grant RobotiZap a limited, non-exclusive and revocable licence to use this data solely to provide the contracted service, in accordance with the Privacy Policy.
• The RobotiZap brand, the software, the dashboard design and the documentation are the property of PK Systems and are protected by law.
10. Backup and availability
We carry out periodic backups of the platform as a service continuity measure. We recommend that you keep your own exports of the reports and data you consider critical.
We aim to keep the platform highly available, but we do not guarantee uninterrupted operation. There may be scheduled maintenance windows, always communicated with reasonable advance notice, and occasional outages caused by third parties (cloud providers, Meta).
11. Limitation of liability
RobotiZap is responsible for delivering the platform as described on the website and operating it with due diligence. Subject to the limits of the Consumer Protection Code and applicable law:
• We are not responsible for business decisions you make based on data from the platform.
• We are not responsible for blocks, restrictions or penalties applied by Meta to your WhatsApp number as a result of misuse by you or your team.
• We are not responsible for unavailability resulting from force majeure, unforeseeable events, third-party failures (Meta, internet providers, electricity supply) or actions taken by you or third parties against your account.
• Any compensation owed by RobotiZap is limited to the amount paid for the subscription in the 12 months preceding the event that caused the damage, except where prohibited by law.
12. Support

13. Changes to these Terms
We may update these Terms of Use to reflect changes in the service, in legislation or in market practice. Material changes are communicated through the admin dashboard or by email. The version in force is always the one published at this address, with the date of the last update at the top. If you do not agree with the new version, you may cancel the subscription under the rules in section 6.
14. Governing law and jurisdiction
These Terms are governed by Brazilian law. The courts of the judicial district (Comarca) of Lajeado-RS are chosen to settle any disputes arising from this agreement, except in cases where the law grants the consumer the right to a more favourable forum.
